Most people think that you have to blow a .08 to be charged with a DUI, but that is no longer the case. One can be charged with a DUI “less safe”. Let me explain. If a police officer believes that one’s driving is impaired by drugs and alcohol and making the roads less safe, one can be charged with a DUI “less safe” even though one blows below the legal limit, such as a .04. For example, if a police officer sees a drivier driving erratically and then notices slurred speech and blood shot eyes, he can charge you with a DUI “less safe.” The bottom line you don’t have to blow a .08 to receive a DUI charge.
